The European Commission has recently fined Canon for taking steps to implement its acquisition of Toshiba Medical Systems Corporation prior to notification to and approval by the Commission. The decision, which Canon plans to challenge in the General Court, once again raises questions about when conduct amounts to gun-jumping.
