Dealing with divergence – a new way forward following the online hotel bookings cases?

The European Competition Network (ECN) Working Group has published the results of its monitoring exercise in the online hotel bookings sector. The Working Group was established in response to the divergent approaches taken by national competition authorities (NCAs) towards narrow parity clauses in agreements between hotels and online platforms. The exercise marks the first major collaborative investigation between NCAs and the European Commission. In an environment where the Commission is facing increasing pressure to grant NCAs a higher level of participation while continuing to ensure a uniform application of European competition law, the ECN Working Group model may be a step in the right direction.
