Slaughter and May acted for the trustee of the BBC Pension Scheme, BBC Pension Trust Limited in British Broadcasting Corporation v BBC Pension Trust Limited and another.
The case, brought by the BBC, concerned the interpretation of the Scheme’s amendment power. The Court of Appeal unanimously dismissed the BBC’s appeal and upheld the High Court’s judgment that the Scheme’s power of amendment protects future service benefits as well as past service benefits.
The Slaughter and May team worked closely with members of the Scheme’s Executive, including the Director of Governance and Operations, Ben Harvey, and the Scheme Legal Counsel, Ali Guy. Counsel for the Scheme were Brian Green KC and Joseph Steadman from Wilberforce Chambers.
This is the second example of our Pensions Dispute Resolution team representing trustee clients on crucial litigation at the Court of Appeal level in the past six months, having also represented Railways Pension Trustee Company Limited, as trustee of the Railways Pension Scheme, in RPTCL v Atos.
